VOUCHER SHOP
General
All deliveries and services of the Hotel Fanes, Daunei Str. 17 in 39048 Selva Val Gardena, T +39 0471795535, VAT No. 00308060219 - and the associated online orders and other online services are subject to these General Terms and Conditions (GTC). Deviating and/or supplementary agreements require the express consent of the Hotel Fanes management and the written form; this also applies to a waiver of the written form requirement.
Delivery and shipping conditions and transfer of risk
The voucher is delivered either in the form of an online voucher that you can print out yourself with a forgery-proof code, pick it up yourself or have it sent to the delivery address specified by the customer. In the case of online vouchers, only a print is relevant to the value and can be redeemed. Should further copies with the same code appear, this is an abuse which has criminal consequences. There is no entitlement to fulfillment and/or delivery, resp. to compensation from Hotel Fanes if someone tries to redeem multiple vouchers with the same code, even if the first redeemer is not the valid holder of the voucher. Rather, a criminal investigation (forgery of documents) can be initiated immediately against the exhibitor with intent to defraud.
Since a voucher can be passed on or given away accordingly, Hotel Fanes has no obligation or option to check the right of ownership of the redeemer. When redeeming, it is only checked whether the corresponding voucher number has really been released by the system and whether the corresponding voucher has actually been paid for.
If delivery to the customer by post is not possible, the transport company commissioned will send the goods back to Hotel Fanes, with the customer having to bear the costs for the unsuccessful delivery. This does not apply if the customer is not responsible for the unsuccessful attempt at delivery or if he thereby exercises his right of withdrawal.
Conclusion of contract in the online shop
The customer can place a binding order by ordering the selected goods (voucher – value voucher) in the online shop by clicking on the order button.
If the customer orders via the online shop by clicking on the order button, the contract is concluded by pressing the "ORDER PAYABLE" button.
Payment, Validity and Use
The prices given by the seller are final prices, i.e. they include all price components, including the statutory Italian VAT. Any additional delivery and shipping costs that may be incurred are specified separately in the offer for the respective product description.
When concluding contracts via the online shop, the seller offers the following payment options, unless otherwise specified in the respective product description in the offer:
For deliveries within Italy and other EU countries: payment in advance by credit card
Deliveries to countries outside the European Union may incur additional costs, such as additional taxes and/or duties, such as customs duties.
The vouchers are usually valid for 1 year (see date and period of validity on the voucher). After this period, Hotel Fanes is no longer obliged to accept it. Lost vouchers will not be replaced. Vouchers cannot be returned for a cash value payment either. If the value of the voucher is more than the service consumed, the Hotel Fanes is prepared to fully offset the remaining voucher balance on further visits. In such a case, there is no entitlement to a payment of the remainder of the outstanding voucher amount. Hotel Fanes is not obliged to accept unpaid vouchers as a means of payment. For operational reasons, the services listed in the voucher can only be provided by the company if a corresponding and timely reservation has been made. This applies in particular to vouchers in connection with overnight stays. The service described in the voucher may differ slightly depending on the event, but must not represent a relevant reduction in value for the guest. If the Hotel Fanes has to close or give up for any reason, the vouchers expire without compensation. This is also the case if the company verifiably changes hands. In such a case, Hotel Fanes cannot be used as the original issuer of the vouchers.

Wherever possible, Hotel Fanes will punctually comply with agreed or specified delivery times. If this is exceeded by more than six weeks, the customer has the right to set a grace period with the notice that he will refuse to accept the voucher after the period has expired. This period of grace must be at least one month. If no agreement can then be reached on a new delivery date, the customer can, after the grace period has expired, withdraw from the contract or withdraw from the degree. Compensation for damages as a result of delay or impossibility of delivery cannot be asserted. This also applies to claims for damages as a result of lost profits or other indirect damage. Further claims of the buyer - in particular for delivery - as well as for any risks and side effects caused by the product are excluded. The risk passes to the customer as soon as the vouchers have been handed over to the transport company and the warehouse or left the company. This also applies if Hotel Fanes has assumed the transport costs. The customer must assert complaints about transport damage to the transport company within the specified periods. In the case of shipments by the customer, the customer bears every risk, in particular the transport risk, until the voucher arrives at the Hotel Fanes
right of withdrawal
There is no right of withdrawal for vouchers that are paid for online and printed out. Vouchers that are paid for by invoice can be revoked within 24 hours and must be returned to the issuer within 3 working days (from the date of issue).
defects
Complaints about the scope of delivery, material defects, incorrect deliveries and quantity discrepancies must be made immediately, but no later than one week after receipt of the goods or of the vouchers, to assert in writing. In the event of justified complaints, the Hotel Fanes will correct the incorrect delivery free of charge and, subject to exclusion, will exchange the vouchers, take them back or grant the buyer a price reduction at its discretion. If, in the case of a voucher being exchanged, the replacement delivery is also defective, the buyer has the right to conversion or reduction.

Final Provisions
The ineffectiveness of individual points of these general terms and conditions (GTC) does not affect the effectiveness of the remaining provisions. The invalid provision is replaced by a new provision that comes as close as possible to the economic effect of the invalid provision. Place of performance and place of jurisdiction for contracts, including these General Terms and Conditions (GTC), is Bolzano, Italy.
